Mandatory Requirements for the Acceptance of Mineral Production Sharing Agreement (MPSA) Applications

MPSA application (Form No. 6-1) Pro Forma MPSA Contract Location Map/Sketch map (Scale: 1:50,000 NAMRIA topographic Map) Showing Coordinates/boundaries with major environmental features/other Projects (prepared signed/sealed by Deputized GE)  Work Program For Integrated MPSA (from Exploration to Operating Period) Exploration Work Program (MGB Form No. 5-4) Environmental Work Program (MGB Form No. 16-1 or 16-1A) For Simple MPSA (from Development/Operating Period) 3-Yr Work Program (MGB From No. 8-2) EPEP (MGB Form NO. 16-2 Certificate of Satisfactory Environmental Management/Community Relations Record/Certificate of Exemption/Application for CEMCRR Proof of Technical Competence including track records in mining operations/environmental management, bio data Proof of financial capability For Individuals Statement of Assets and Liabilities duly sworn in accordance with existing laws Latest Income Tax Return (ITR) Credit Lines/Bank Guarantees/Deposits of at least 2.5 Million Pesos For corporations/partnerships/Assn/Coop. Latest Audited Financial Statement Annual Report for the Preceding Year Certified Photocopy of SEC Registration Articles of Incorporation and By-Laws Minimum Authorized Capital Stock of P10 Million Minimum Paid up Capital of P2.5 Million Credit Line/Bank Guarantees/Deposit Declaration of Total Area covered by Approved/pending Mineral Agreement/Applications Affidavit of Undertaking Proof of payment of filing and PD 1856 fees Corporate Secretary’s Certificate Authorizing the Corporation’s Representative to file/sign and/or transact with the Bureau concerning the MPSA proposal For Individual applicant - A Special Power of Attorney in Case the Filer is other than the applicant

Additional Requirements For Simple MPSA

Environmental Compliance Certificate Mining Feasibility Declaration of Mining Project Feasibility Mining Project Feasibility Study Approved Survey Plan Appropriate Environmental Report on the rehabilitation of mined-out and/or mine waste/tailings covered areas and Anti pollution measures undertaken during the mining operation Certification from the concerned Regional Office that the mining/quarry claims are valid and subsisting
